TERMS OF SERVICE FOR XSYS WEBINARS

Please read these terms of service (hereinafter: Terms of Service) carefully before using our Webinars. 

The following terms and conditions govern all use of the XSYS webinars (hereinafter: Webinars). By using any Webinars you are agreeing to be bound by and comply to these Terms of Service.

Acceptance of the Terms of Service is voluntary, but it is a prerequisite for accessing and usage of Webinars.

Accepting these Terms of Service constitutes the entire agreement between XSYS and User concerning the subject matter hereof.

Violation of any of the Terms of Service below will result in the immediate termination of your account and you will no longer have access to Webinars. 

Any comments, requests and complaints regarding the functioning of the Webinars provided by XSYS should be reported to the e-mail address info@xsysglobal.com

The provider of Webinar is XSYS. XSYS is part of Flint Group Germany GmbH with its headquartered in Luxembourg and offices in many countries around the world. All our locations and contact data you can find here.

GENERAL PROVISIONS

To use Webinars you must:

  • be a representative of legal person or an entrepreneur with full legal capacity;
  • provide your full name, a valid email address, and any other information requested in order to complete the registration process;
  • accept and respect Terms of service;
  • acknowledge the privacy statement and cookie policy.

Registration for Webinar is voluntary, but it is a prerequisite for accessing and usage of Webinars.

Registration can be done only via official XSYS website.

TECHNICAL REQUIREMENTS

To use the Webinars, a device connected to the Internet and equipped with an appropriate web browser, compliant with generally available technological standards for home and mobile devices for 2021, is required.

In order to avoid potential threats, we require all users to use electronic devices which are connected to the Internet with an anti-virus program and to constantly update it.

In order to avoid potential threats, we warn all users against the potential threat related to the activity of the so-called hackers, aimed at breaking into both the user’s system and ours, as well as phishing attempts with use of fake websites. Users should provide their personal data carefully.

The data transmission costs required to download documentation and use the website and Webinars are borne by the user.

XSYS is not responsible for any limitations or technical problems in systems used by users’ devices, in particular that prevent or limit users from using the Webinars.

RESPONSIBILITY

Users are responsible for safe and reasonable management of their personal data during registration.

It is forbidden for all users to provide illegal content and to use the Webinar in a manner that is against the law, decency, regulations or infringes the personal rights of third parties. Users are entirely responsible for the content and any harm resulting from that content. 

XSYS has the right (though not the obligation) to, in their sole discretion refuse or remove any content that, in XSYS’s reasonable opinion, violates any XSYS policy or is in any way harmful or objectionable, or deny access to and use of Webinars to any individual or entity for any reason, in XSYS sole discretion and without prior warning or subsequent notification to the individual account holder or entity, and XSYS will have no obligation to provide any compensation due to it’s decision.

User may terminate these Terms of Service by discontinuing to use Webinars at any time. All provisions of these Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. 

User agrees to indemnify and hold harmless XSYS and it’s provider, contractors, licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of against the law and Terms of Service use of the Webinars.

INTELECTUAL PROPERTY

We value and respect intellectual property rights.

Webinars including in particular software, graphic and functional layout, works, trademarks, logos, databases, texts, photos, graphics, sounds, IT programs and multimedia materials are subject to legal protection provided for in the applicable the scope of the law.

All rights to the Webinars and all its elements are entitled to XSYS or third parties that XSYS cooperates with.

The use of the content provided in the Webinars does not mean that any User acquires any intangible rights to the shared works or databases.

If you believe that material located on or linked in our Webinars violates your copyright, you are encouraged to notify XSYS. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of XSYS Cloud or others, XSYS may, in its own discretion, deny access to and use of the Webinar and claim compensation.

DISCLAIMER

The Webinars are provided “as is”. XSYS and its suppliers and licensors hereby disclaim all warranties of any kind.

XSYS does not warrant that Webinars will meet your specific requirements, will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the service will be accurate or reliable, the quality of any information or other material will meet your expectations, and any errors in the Webinars will be corrected.

In no event will XSYS, or its suppliers or licensors, be liable with respect to any subject matter of these Terms of Service under any contract, negligence, strict liability or other legal or equitable theory for any special, incidental or consequential damages; the cost of procurement or substitute products or services; for interruption of use or loss or corruption of data.

AMENDMENTS

XSYS has the right to update and change the Terms of Service from time to time without prior notice.

Continued use of the service after any such changes shall constitute your consent to such changes.

COMPLAINTS

If you have any complaint or request on our Webinars please contact us using email address: trendelina.kryeziu@flintgrp.com

The complaint should contain the data necessary for its consideration, such as: User’s contact details, the current version of the operating system installed on your device, as well as a detailed description and indication of the reason for the complaint.

XSYS considers complaints within 30 days of receipt of the complaint, but this period may be extended by another 30 days in the event that the examination of the complaint requires a longer time. 

XSYS will inform you about the extension of the complaint examination period, indicating the period for which the complaint will be extended and the reason for the extension. Information on the extension of the examination of the complaint and its reason will be provided to the User. 

In the event that the submitted complaint contains deficiencies that prevent its consideration, if it deems it necessary for the proper consideration of the complaint, XSYS shall immediately contact you to supplement it, specifying the date, not shorter than 7 days and the scope of this supplement, with instruction, that failure to complete the complaint within the specified period will result in leaving the complaint unrecognized. After the expiry of the deadline, the complaint shall not be considered.

MISCELLANEOUS

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Court jurisdiction for any dispute arising from these Terms of Service shall be the court of Amsterdam. The UN Convention on Contracts for the International Sale of Goods (CISG) is not applicable.

A failure or delay by a Party to exercise any right or remedy provided under these Terms of Service or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under these Terms of Service or by law shall prevent or restrict the further exercise of that or any other right or remedy.
